Question:
have a client who drove truck a good part of his life. He has developed back
problems and can no longer drive. He has made a claim for worker's compensation and has
been denied coverage. Worker's comp says it is arthitis and not work related.
On occasion when he is driving, he has severe back spasms and when he stops to
get out of the truck he can hardly walk. I need to know if there are other truckers who
suffer from back problems caused by driving truck. I suspect there are many others and
that the cause of the injury is the vibration and jar which occur while the truck is
being driven down the road.
Also, worker's comp says they have to be able to identify a specific work
related incident when the back injury occurred. Does this make any sense? Again, I
suspect this kind of injury would come on gradually after many years on the road. Can
anyone help?
Answer:
I was disabled for a back injury for
nearly a year back in 1993-94. I made
no hesitation in getting a lawyer right
away. In most cases , their services
are required in these situations. Sure
enough , my initial claim was denied
but , with my attorney's immediate action
, my benefit checks came right away.
