Question:
have a severe back problem that is impacting my ability to live normally.
Over the past 10 years or so I have had a lot of problems with my back and I
believe I can trace these problems to a job I left 6 years ago. I worked
there for 10.5 years. I was doing very heavy lifting on that job and was not
given any training in how to do this without injuring myself.
Q: Is there a statute of limitations that governs whether or not I can sue
at this point?
Answer:
The first thing that jumps out is whether your employer was a workers' comp subscriber. The rules
and rights vary significantly from the work comp context to the personal injury context (eg. common
law negligence).
Next, six years is normally longer than most limitations periods. Nonetheless, there is usually a
rule (the "discovery rule") that keeps the clock from ticking until you discovered your injury (or
should've discovered it).
Bottom line: If you want preserve whatever
claim you may still have, go see a CT
work comp or PI lawyer asap. Many, if
not most, give a free consultation.
